Blog Assignment - Nov. 15-23

Should an employer be able to fire an employee for disparaging, insubordinate remarks made on social networking sites like Facebook?  Some people feel that slanderous talk about a company should be relegated to open, non-electronic forums and should not be posted on sites like Facebook.  Read the following article about a woman who is now suing her company stating that her 1st amendments rights were violated by her wrongful termination.  Facebook Firing

  1. I don't think it's appropriate for an employer to fire an employee for any type of remarks made on a social website dealing with their personal life. What does that have to do with their job? I agree it does violate the First Amendment (freedom of speech, etc.) you should be able to express your feelings wherever you want to. Just because she had a job doesn't mean they need to interfere in her personal life/ business. That isn't their place. They should definitely be sued.

  2. Why does it matter if someone says something on facebook? People should be able to say what they want or put on what they want online as long as its not harmful to otheres, (ex:threats, cyberbullying, saying your going to kill someone)But if you are stating your opinion then thats fine.
    I agree with eduardo because it is on a persons own time. If they're being positive at work and not talk about it at work then thats fine. And if you slander at work about the company and your on the clock, ok it maybe violate the 1st amendment. But if its on someones own time. And on private facebook (you can choose who and who are not your friends) then i would say that definatly violates the freedom of speech.

  4. I think that everybody should have the rights to says whatever they wants on facebook without getting into any kind of problems. Fire an employee for that is just wrong. The freedom of speech gave the people the right to express their own opinion and that's what the employee have the rights to do.
    I agree with matt because he had the same opinion that i had about this article.

  5. What she did might have been immature but she still has the freedom of speech as a citizen of the United States. Firing an employee over a facebook comment is stupid. Her company that she worked for should feel dumb for firing her because she was just expressing her feelings. I agree with Matt because it wasnt a threat just her stating her opinion.

I agree that with atran419 that what she said was immature. i don't think they should have fired her over that; i think that they should have told her that they didn't want her posting stuff like that on facebook anymore because it is bad for the company.I think the company took it a little too far.

  7. I can see the argument from both perspectives. In some way you should keep the things you post on the internet appropriate. If you have a facebook and you don't want anything to happen because of the things you post then you shouldn't add/be friends on facebook with people you work with. Otherwise, something you post is bound to get you in trouble.

I believe that talking about her boss on facebook was wrong but,and there is freedom of speech as well and i dont think they should've fired her because of it,they should've pulled her aside and made it clear that its not good for the company that she post inappropiate comments on facebook anymore.

    I agree with matt,the person needs to keep a positive attitude at work,but as for their own time,it shouldn't matter because its freedom of speech,and stating her opinion.

    i also agree with atran419,it was immature of her to post something on facebook about her boss.

  9. My opinion is that if you have a facebook you should be aware that when you post something everyone who is friends with you can see it. If you don't want others to see what you write then don't add them. I do believe that we all have freedom of speech but sometimes some of us need to watch out what we post on facebook especially when were upset or mad about something. They shouldn't of fired her for that comment.
    I agree with michelleP You should keep what you post on Facebook appropriate.

  10. An employer should not be able to fire a fellow employee because of there thoughts on a social networking site, nor even at the work place, but not in front of customers. Workers have the right to talk about there working conditions among other fellow employees and whom ever else they feel like telling. The employer fired the employee basically because he was upset about the remarks made about his work ethic. Not a very good reason to fire someone.

    I agree with Michelle also, the things you do say on Facebook are worldwide publicity, anyone can see it. Profanity used would make the business's image look bad to customers, which would be a serious reason to let someone go. But if its appropriate, then they can say whatever they want

  11. i dont think that it is appropriate nor ethical for an employer to fire an employee just because of one remark. as long as the remarks are not threatening to the company or place of work, why should the employers care? its not like its hurting them in any way. thats a violation of the first amendment(freedom of speech/expression).

You know, my teacher ounce said you should be careful of what you put on the web were everyone can see, cause it could cause a conflict that could cause trouble to you or the things you talk about, however that shouldn't give other people the right to get you fire over such a matter, you should have a chance to clear things up and apolagize for your actions instead.

    I agree with DMujica that you should be carefule on facebook.

  14. i think that everyone has a right to say what they believe in and if your company has a problem with it, then maybe it isn't your fault for saying that. i mean why should the company try to hide the bad when all they have to do is fix it? instead of firing people they should just work on what the employee said.

  15. I don't think it is correct to be fired over something that is said over the Internet. One should be smarter than saying something about a co-worker or boss in a disrespectful way. I believe that is also ones personal opinion and they should not be punished for what is said or typed.

    I agree with Bryan, how the employer most liekly fired the employee just for a remark made.

  16. To fire someone over their conduct online would be like firing a person for their conduct at home, or in a bar or wherever they may be. A workplace should only have control over what occurs in the workplace. Beyond that the employee is in the privacy of their own life and feelings. If a conflict grows out of an online experience than a meeting should be made at the most, but never to the extreme of someone losing their job.

    I agree with Stephanie, second place but i also think they should not be punished.

    Employers should be focused on how the employee behaves while working, not focused on how they act outside of the workplace.

  18. Azianboy makes a good point that we have the first amendment right.

    It was just an opinion about her boss and a lot of people work with others they don't really like. It's a way for others to blow off steam when having a stressful day. There's always that one person who is going to make you mad but just because they're an employee doesn't mean they have to fire them. Can call them to your office and talk to them about it. Much simpler than getting the story in the news and having others see the stupid problems people have at work.
    Facebook is public but only to those who befriended you. Can set it to certain privacies if you're worried about people seeing it also.

  19. I agree with Jenny Allen in that an employee should not be fired over their opinion about their job or boss. It is their right to feel the way they do and their right to talk to their friends in any form to get support or comfort. It is health for people to express themselves especially in a safe and non physical way. Many jobs in today's society have a great deal of pressure and tension which needs to be let out in one way or another at least if it is only writen somewhere like facebook it is not causing harm to anyone.

  20. an employee should not be fired over what they say on facebook. but i kinda goes both ways. employers look at facebooks and so do colleges to see if your a good employee or a candidate. if she wrote stuff on her wall before she was hired then they should not have hired her. so i think that they both were wrong.

  21. Being fired from someting said on line is a bit over board. Facebook is not a place to bash other people but its also not a place where your employees should go and tell on you or your boss to go look and see what you post. i dont think you should be fired over your opnion.

  25. I dont think that people should get fired of what they put on their facebook etc about their life. Because they are still human and they still like to enjoy them self and others. They still have the freedom to speak whatvever they like (free speech). But on the other hand they know that companys check their employees facebook so they should watch what they put cause they dont know who might be watching

  28. I agree with the article saying that you can get together on your own time and talk about who you want. If it is your own personal time then it shouldn't matter with other employees. I disagree with making it public on Facebook so other employees could see. It's not right to put bad things on the internet about another person, because it will always be there.

  29. I think that if a person really feels the need to make a negative comment about a boss or the company, then they should not be working there. People need to be mature and handle situations differently other than posting it on facebook where the public can see all you are saying.

  30. I think that the employee should not put negative remarks about the company they work for on facebook. If they have a problem with how things are then they should go to their boss and talk to them about it instead of going on facebook to voice their opinion. Or they can quit. But as long as the company they work for is signing their checks and paying their bills they should keep their mouth shut.

  31. i don't think its right to be fired over something you said on your facebook. Your facebook should be personal, and should have nothing to do with your work life. But i do think she was stupid for writing that about the company she works for knowing nothing is private on the internet.

  32. I'm on the employers side. The internet is a huge place and once it's on there it's never gone. To talk bad about someone bad on facebook is horrible already, and she did it about her boss. It's basically if you called your boss phyciatric patient to his face, you don't think you wouldn't get fired? You can get fired for anything, but issue is if you get unemployment. But honestly if it was a first time offense a warning would be appropriate, but she just got two bad complaints so I think she should have been fired.

  35. What a person has to say or do outside of their work area, should be their own personal business. I also think that the employee should have had some common sense before posting stuff on her Face book knowing it would somehow get back to their work area.
